1. About Us

2. About You
These Terms & Conditions apply to all users of the site, including without limitation users who are browsers, trade buyers, customers, and/or contributors of content. 

By placing an order through our site, you warrant that:

  • you are legally capable of entering into binding contracts 
  • you are at least 18 years old 
  • you are resident in either the US, UK or another European Union member state; and 
  • you are accessing our site from the US, UK or another European Union member state 

Our Service is mainly focussed on UK mainland and US customers, however, by arrangement we can deliver to additional overseas locations - please contact our Customer Services for more information, please note delivery costs mentioned on our site are for deliveries within the UK mainland or US only.  

Our store is hosted on Shopify Inc. They provide us with an online e-commerce platform that allows us to sell our products and services to you. 

3. Our Products
All descriptions of the Products on our site are correct at the time of publication on our site. We have a policy of continuous product development and reserve the right to amend the specification of Products without prior notice in relation to future sales. 

We try to ensure the pictures of the goods on our website are accurate. However, there may be slight variations in colour and texture between the pictures and the goods themselves due to the colour of the monitor you are using to view the site.  

The measurements of the Products are as accurate as possible but are nevertheless approximate. We offer some of our products in bespoke sizes. The final dimensions of the finished product will be within 2 cm (0.78") of the requested measurements.

It is your responsibility to check that all the details on the order form are correct, including the exact specifications of the Products and delivery details. 

Finishes are applied to the exterior of our Products. Due to the nature of the materials and the artisan processes we use, finishes may vary & shade variation can occur between different batches. 

Our Products on our UK site are intended solely for domestic use in the UK, and our Products on our US site are intended solely for domestic use in the US and we give no guarantees or undertakings in respect of the use of our Products for commercial purposes. By agreeing to these terms and conditions, you agree that we are in no way responsible for any non-domestic or commercial use of our Products and that you have no rights to cancel this purchase if you are purchasing the product in a business capacity. 

Stock availability and delivery dates provided on the website and subsequently communicated in any form are estimates and cannot be guaranteed. 

Occasionally there may be information on our site or in the Service that contains typographical errors, inaccuracies or omissions that may relate to product descriptions, pricing, promotions, offers, product shipping charges, transit times and availability. We reserve the right to correct any errors, inaccuracies or omissions, and to change or update information or cancel orders if any information in the Service or on any related website is inaccurate at any time without prior notice (including after you have submitted your order). 

4. Orders & Ordering
Orders shall be accepted at our sole discretion but will usually be accepted if the goods that you order are available and your credit card is authorised for the transaction. Your card will be charged automatically when you place your order. If for any reason we are unable to fulfil your order, a full refund will be given. 

When you place your order we will send you a Confirmation by email, and the contract between us becomes binding at this time. You will own the goods once they have been delivered to the address specified and when we have received cleared payment in full. Until that time then we will retain the title to the goods. We will contact you if there are any problems. 

5. Consumer rights
This section applies only to individuals who order from us. It does not apply to business or commercial customers or those individuals who purchase a product for business or commercial use. 

If you are contracting as a consumer, you may cancel a Contract at any time within 14 days, beginning on the day after you received the Products. In this case, you will receive a full refund of the price paid for the Products in accordance with our Refunds and Returns Policy. The exception to this is if you have ordered a "Bespoke" Product (e.g. made-to-measure sofa). 

In addition, certain products or services may be available exclusively online through the website. These products or services may have limited quantities and are subject to return or exchange only according to our Return Policy. 

To cancel a Contract, you must inform us in writing or by email or by telephone. In addition, the Products must be in the same condition in which you received them which means, for the avoidance of doubt and without limitation, that they must be in perfect resaleable condition and undamaged in any way. You have a legal obligation to take reasonable care of the Products while they are in your possession.  

Details of this statutory right, and an explanation of how to exercise it, are provided in the Order Confirmation. This provision does not affect your statutory rights. 

6. Import duty
If you order Products from our site for delivery outside the UK mainland, they may be subject to import duties and taxes which are levied when the delivery reaches the specified destination. You will be responsible for payment of any such import duties and taxes. Please note that we have no control over these charges and cannot predict their amount. Please contact your local customs office for further information before placing your order. 

Please also note that you must comply with all applicable laws and regulations of the country for which the products are destined. We will not be liable for any breach by you of any such laws. 

7. Our Site, Images & Copyright
You may not use our products or images for any illegal or unauthorised purpose, we own Copyright on all content on our website. 

You agree not to reproduce, duplicate, copy, sell, resell or exploit any portion of the Service, use of the Service, or access to the Service or any contact on the website through which the service is provided, without express written permission by us. This includes all images and copy. Sharing on Social Media is allowed when including a link back to nicolaharding.com 

8. Personal Information

9. Our Liability
We warrant to you that any Product purchased from us through our site is of satisfactory quality and reasonably fit for all the purposes for which products of the kind are commonly supplied. 

Our liability for losses you suffer as a result of us breaking this agreement is strictly limited to the purchase price of the Product you purchased and any losses which are a foreseeable consequence of us breaking the agreement. Losses are foreseeable where they could be contemplated by you and us at the time your order is accepted by us. 

We are not responsible for indirect losses which happen as a side effect of the main loss or damage and which are not foreseeable by you and us, including but not limited to: 

  • loss of income or revenue; 
  • loss of business; 
  • loss of profits or contracts; 
  • loss of anticipated savings;
  • loss of data; or waste of management or office time however arising and whether caused by tort (including negligence), breach of contract or otherwise.

10. Online January Sale Terms & Conditions

1.Promotion Period
The NiX Sale will run from Monday 23rd December  2025 to Friday January 29st 2026. The Sale is only valid for purchases made within this timeframe. The Seller reserves the right to extend or cancel the Sale at any time without notice.

2.Discounts and Pricing

  • All prices during the Sale are subject to change and may be discounted compared to regular prices. Discounts and offers are clearly marked on the product page.
  • The discount applies only to selected products as indicated in the Sale listing and is not applicable to prior purchases.
  • Prices are listed in GBP, and the final price includes any applicable taxes but may exclude shipping fees, which are calculated at checkout.

3. Returns and Exchanges

  • Return Period: Items purchased during the January Sale are eligible for returns or exchanges within 28 days of when we delivered them.
  • Refunds on products purchased during the sale period will only amount to the price advertised in that period.

4. Promotions and Vouchers

  • The discount does not apply to vouchers, courses & consultations service.  
  • Some existing discount codes or vouchers may not apply on top of the sale discount.

5. Product Availability

  • All products in the The NiX Sale are subject to availability. If an item is out of stock after an order is placed, the Seller will notify the buyer, and the buyer may choose to cancel or modify the order.
  • The Seller reserves the right to limit the quantity of certain items purchased.

6. Delivery and Lead Times

  • Whilst we make every effort to ensure your pieces are made and delivered in reasonable time, during periods of high demand such as Christmas or sales periods, our expected lead times may differ from the approximated lead times on the product pages. These lead times and delivery times should be understood as approximations rather than definitive dates.

11. Delivery and Returns
Delivery times are estimates and may vary due to stock availability, shipping carrier delays, or destination location. International delivery options are not advertised, however can be arranged on an ad-hoc basis, with the customer service team providing bespoke quotes for pricing and arrangements.

If your order contains items with different availability (e.g. in-stock and made-to-order), these may be shipped separately at no extra cost.

Ownership of goods transfers to you once they are delivered and we have received cleared payment. Prior to this, title remains with us. If upon receipt of the item and in the presence of the delivery team the piece is rejected due to fault or is otherwise incorrect, we will take the product back without return fees. Later refusal or return of the items may require return fees for the collection of the item.

Our delivery team provides a report of the condition of the product upon delivery and installation. If you have any issues or notice any snags, please raise this with the delivery team on receipt of the item for them to be recorded in the report. Any damages incurred after delivery and following our report cannot be assumed by our delivery team. Risk of loss passes to the customer at delivery. 

You will be responsible for the cost of returning the goods to us, and will remain responsible for any and all returned goods until they reach our warehouse. We strongly advise that a proof of postage certificate should be obtained when returning any part of your order. Certificates are available free of charge from the post office.

We have a “no-quibbles” returns policy. Most items can be returned within 28 days of delivery, provided they are in original condition and packaging (unless we removed packaging at delivery). Upholstered pieces made with your own supplied fabric are non-refundable. Returns can be made to our Queens Park showroom address, or to one of our warehouses at our discretion.

Please contact us quoting your invoice number, no later than 28 days from the date you receive your purchase, stating that you will return the item including the original packaging. Provided the item is in saleable condition, we will exchange or replace the item(s) or credit the amount against a future purchase.

For medium and large items, cancellations within 48 hours of the agreed delivery date, or failed deliveries where no one is available to accept delivery, may incur a failed delivery charge of £75. Additional charges may apply for deliveries outside the UK mainland.
